國(guo)務院辦公(gong)廳關于開展城鎮小區配套幼兒園(yuan)治理工作的通知(zhi)

各省、自治(zhi)區(qu)、直轄市人(ren)民政府,國務院各部委、各直屬機構:
城鎮(zhen)小(xiao)區配(pei)(pei)套(tao)建(jian)(jian)設幼(you)(you)兒園(yuan)是(shi)城鎮(zhen)公(gong)共服(fu)務設施建(jian)(jian)設的(de)重要內(nei)容(rong),是(shi)擴大普惠性學前教育資源的(de)重要途徑,是(shi)保(bao)障和(he)改善(shan)民生的(de)重要舉措。2018年11月,黨(dang)中(zhong)央(yang)、國務院印發(fa)《關(guan)于學前教育深(shen)化改革(ge)規(gui)(gui)范發(fa)展的(de)若干意見(jian)》,提(ti)出規(gui)(gui)范小(xiao)區配(pei)(pei)套(tao)幼(you)(you)兒園(yuan)建(jian)(jian)設使用,并對小(xiao)區配(pei)(pei)套(tao)幼(you)(you)兒園(yuan)規(gui)(gui)劃、建(jian)(jian)設、移交、辦園(yuan)等情(qing)況進行治理(li)(li)作出部署。為落實相關(guan)要求(qiu),經國務院同意,現就開(kai)展治理(li)(li)工作有(you)關(guan)事(shi)項通知如下(xia):
一、總體要求
以習近(jin)平(ping)新時代(dai)中國特色(se)社會(hui)主義(yi)思(si)想為指導(dao),全(quan)面貫徹黨的(de)十(shi)九大和十(shi)九屆二中、三中全(quan)會(hui)精神,落(luo)實(shi)全(quan)國教(jiao)(jiao)育(yu)大會(hui)部署,堅持以人民為中心(xin)的(de)發展思(si)想,認(ren)真履(lv)行政(zheng)府責任(ren),依法落(luo)實(shi)城鎮公共服(fu)務設(she)施建(jian)設(she)規(gui)定,著力構建(jian)以普(pu)惠性資源為主體的(de)學前(qian)教(jiao)(jiao)育(yu)公共服(fu)務體系,聚焦小區配套幼兒園(yuan)規(gui)劃、建(jian)設(she)、移交、辦(ban)園(yuan)等環節(jie)存在的(de)突出(chu)問(wen)題(ti)開展治理,進(jin)一步提高(gao)學前(qian)教(jiao)(jiao)育(yu)公益普(pu)惠水平(ping),切實(shi)辦(ban)好學前(qian)教(jiao)(jiao)育(yu),滿足人民群眾對(dui)幼有所育(yu)的(de)期(qi)盼。
二、工作任務
1.城(cheng)(cheng)鎮(zhen)小(xiao)區(qu)(qu)嚴(yan)格(ge)依標配(pei)(pei)建(jian)(jian)(jian)(jian)(jian)(jian)幼(you)兒(er)園(yuan)。嚴(yan)格(ge)遵(zun)循(xun)《中(zhong)華人(ren)民共(gong)和(he)國(guo)(guo)城(cheng)(cheng)鄉規(gui)劃(hua)法》和(he)《城(cheng)(cheng)市居(ju)(ju)住區(qu)(qu)規(gui)劃(hua)設(she)(she)計標準(zhun)》(GB 50180),老城(cheng)(cheng)區(qu)(qu)(棚戶區(qu)(qu))改(gai)造、新城(cheng)(cheng)開發(fa)和(he)居(ju)(ju)住區(qu)(qu)建(jian)(jian)(jian)(jian)(jian)(jian)設(she)(she)、易地扶貧搬遷應將配(pei)(pei)套(tao)建(jian)(jian)(jian)(jian)(jian)(jian)設(she)(she)幼(you)兒(er)園(yuan)納入(ru)公共(gong)管理和(he)公共(gong)服(fu)務設(she)(she)施建(jian)(jian)(jian)(jian)(jian)(jian)設(she)(she)規(gui)劃(hua),并按照相關(guan)標準(zhun)和(he)規(gui)范(fan)予(yu)以建(jian)(jian)(jian)(jian)(jian)(jian)設(she)(she)。城(cheng)(cheng)鎮(zhen)小(xiao)區(qu)(qu)沒有規(gui)劃(hua)配(pei)(pei)套(tao)幼(you)兒(er)園(yuan)或(huo)規(gui)劃(hua)不(bu)足,或(huo)者有完(wan)整規(gui)劃(hua)但(dan)建(jian)(jian)(jian)(jian)(jian)(jian)設(she)(she)不(bu)到(dao)位的,要依據國(guo)(guo)家和(he)地方配(pei)(pei)建(jian)(jian)(jian)(jian)(jian)(jian)標準(zhun),通過(guo)補建(jian)(jian)(jian)(jian)(jian)(jian)、改(gai)建(jian)(jian)(jian)(jian)(jian)(jian)或(huo)就近新建(jian)(jian)(jian)(jian)(jian)(jian)、置換、購置等方式予(yu)以解(jie)決。對存在配(pei)(pei)套(tao)幼(you)兒(er)園(yuan)緩(huan)建(jian)(jian)(jian)(jian)(jian)(jian)、縮建(jian)(jian)(jian)(jian)(jian)(jian)、停建(jian)(jian)(jian)(jian)(jian)(jian)、不(bu)建(jian)(jian)(jian)(jian)(jian)(jian)和(he)建(jian)(jian)(jian)(jian)(jian)(jian)而不(bu)交等問題的,在整改(gai)到(dao)位之前,不(bu)得辦理竣工驗收。
2.確(que)保小區配套(tao)幼(you)兒(er)園(yuan)如期移(yi)(yi)交(jiao)。已(yi)(yi)建成(cheng)的小區配套(tao)幼(you)兒(er)園(yuan)應按照規(gui)定及(ji)時移(yi)(yi)交(jiao)當(dang)地(di)(di)教育行政部(bu)(bu)(bu)門,未移(yi)(yi)交(jiao)當(dang)地(di)(di)教育行政部(bu)(bu)(bu)門的應限期完成(cheng)移(yi)(yi)交(jiao),對(dui)已(yi)(yi)挪(nuo)作(zuo)他用的要采取(qu)有(you)效措施予以收回。有(you)關(guan)部(bu)(bu)(bu)門要按規(gui)定對(dui)移(yi)(yi)交(jiao)的幼(you)兒(er)園(yuan)辦理土地(di)(di)、園(yuan)舍移(yi)(yi)交(jiao)及(ji)資產(chan)登記手(shou)續。
3.規范(fan)小(xiao)區(qu)配套幼兒園(yuan)使用。小(xiao)區(qu)配套幼兒園(yuan)移交當地教育行政(zheng)部門后,應當由教育行政(zheng)部門辦(ban)成(cheng)(cheng)公辦(ban)園(yuan)或委(wei)托(tuo)辦(ban)成(cheng)(cheng)普(pu)惠性(xing)民(min)辦(ban)園(yuan),不得(de)辦(ban)成(cheng)(cheng)營利性(xing)幼兒園(yuan)。辦(ban)成(cheng)(cheng)公辦(ban)園(yuan)的,當地政(zheng)府及(ji)有關(guan)部門要做好(hao)機構編(bian)制、教師配備等方(fang)面的工(gong)作;委(wei)托(tuo)辦(ban)成(cheng)(cheng)普(pu)惠性(xing)民(min)辦(ban)園(yuan)的,要做好(hao)對相(xiang)關(guan)機構資(zi)質、管(guan)理能(neng)力、衛生安全及(ji)保教質量(liang)等方(fang)面的審核,明確(que)補助標準,加強對普(pu)惠實效(xiao)及(ji)質量(liang)方(fang)面的動態(tai)監管(guan)。
三、工作措施
1.摸底排查(cha)。各地(di)以縣(市、區)為單位,對城鎮(zhen)小區配(pei)套幼(you)兒園(yuan)情況進行全面摸底排查(cha),針(zhen)對規(gui)劃、配(pei)建、移(yi)交、使用不到(dao)位等情況,分別列出清單、建立臺賬。該項工(gong)作于2019年(nian)4月底前完成。
2.全面(mian)整改(gai)。針對(dui)摸底(di)(di)排查出的問(wen)題(ti),從實際出發,認真制定有針對(dui)性(xing)的整改(gai)措施,按照“一(yi)(yi)事一(yi)(yi)議”、“一(yi)(yi)園一(yi)(yi)案”的要求逐一(yi)(yi)進行整改(gai)。對(dui)于(yu)已經建成(cheng)、需(xu)要辦理(li)移交手續的,原(yuan)則(ze)(ze)上(shang)于(yu)2019年(nian)(nian)6月(yue)底(di)(di)前(qian)完(wan)(wan)成(cheng);對(dui)于(yu)需(xu)要回收、置換(huan)、購(gou)置的,原(yuan)則(ze)(ze)上(shang)于(yu)2019年(nian)(nian)9月(yue)底(di)(di)前(qian)完(wan)(wan)成(cheng);對(dui)于(yu)需(xu)要補建、改(gai)建、新建的,原(yuan)則(ze)(ze)上(shang)于(yu)2019年(nian)(nian)12月(yue)底(di)(di)前(qian)完(wan)(wan)成(cheng)相關建設規劃,2020年(nian)(nian)12月(yue)底(di)(di)前(qian)完(wan)(wan)成(cheng)項目(mu)竣工驗(yan)收。
3.監督評估。對(dui)各地自查(cha)、摸排、整改等環節(jie)加強督導、監督和評估,并針對(dui)關鍵環節(jie)適(shi)時進行抽查(cha),對(dui)落實不力、整改不到位(wei)的(de)地區(qu)進行通報(bao)。
四、組織實施
1.建立治(zhi)理(li)(li)工(gong)(gong)作(zuo)(zuo)協調機制。成(cheng)(cheng)(cheng)立城(cheng)鎮小區配套幼兒(er)園治(zhi)理(li)(li)工(gong)(gong)作(zuo)(zuo)小組(zu),組(zu)長(chang)由協助分管教育工(gong)(gong)作(zuo)(zuo)的國務院副秘書長(chang)擔任,成(cheng)(cheng)(cheng)員由教育部、住房(fang)(fang)城(cheng)鄉建設部、發展改革委、民政(zheng)部、自然資源部等部門負責同志組(zu)成(cheng)(cheng)(cheng)。治(zhi)理(li)(li)工(gong)(gong)作(zuo)(zuo)聯(lian)合(he)辦公(gong)室設在教育部、住房(fang)(fang)城(cheng)鄉建設部。各地(di)要參照建立相(xiang)應工(gong)(gong)作(zuo)(zuo)機制,加強治(zhi)理(li)(li)工(gong)(gong)作(zuo)(zuo)協調。
2.落(luo)(luo)實治(zhi)理(li)責任分工。按(an)照小(xiao)(xiao)區配(pei)(pei)套(tao)(tao)幼兒(er)(er)園(yuan)(yuan)(yuan)規劃(hua)(hua)、建(jian)(jian)設(she)、移(yi)(yi)交、辦園(yuan)(yuan)(yuan)等各個環節的(de)(de)工作要(yao)(yao)(yao)(yao)求,明晰各項(xiang)工作的(de)(de)主責部(bu)(bu)(bu)門(men)及配(pei)(pei)合部(bu)(bu)(bu)門(men),建(jian)(jian)立(li)聯審聯管機(ji)制(zhi),切實把摸底排(pai)查、全面整(zheng)改等各項(xiang)任務落(luo)(luo)到實處(chu)。教育行(xing)政(zheng)部(bu)(bu)(bu)門(men)要(yao)(yao)(yao)(yao)參與(yu)小(xiao)(xiao)區配(pei)(pei)套(tao)(tao)幼兒(er)(er)園(yuan)(yuan)(yuan)規劃(hua)(hua)、建(jian)(jian)設(she)、驗(yan)收、移(yi)(yi)交等各個環節的(de)(de)工作。發展改革部(bu)(bu)(bu)門(men)要(yao)(yao)(yao)(yao)參與(yu)小(xiao)(xiao)區配(pei)(pei)套(tao)(tao)幼兒(er)(er)園(yuan)(yuan)(yuan)建(jian)(jian)設(she)項(xiang)目規劃(hua)(hua)布局,對(dui)需要(yao)(yao)(yao)(yao)補建(jian)(jian)、改建(jian)(jian)、新建(jian)(jian)的(de)(de)項(xiang)目按(an)程序(xu)及時(shi)(shi)辦理(li)審批(pi)、核準(zhun)或(huo)備案手(shou)續。自然(ran)資源部(bu)(bu)(bu)門(men)要(yao)(yao)(yao)(yao)根(gen)據(ju)國(guo)家和地(di)方配(pei)(pei)建(jian)(jian)標準(zhun),統(tong)籌(chou)規劃(hua)(hua)城鎮小(xiao)(xiao)區配(pei)(pei)套(tao)(tao)幼兒(er)(er)園(yuan)(yuan)(yuan),將小(xiao)(xiao)區配(pei)(pei)套(tao)(tao)幼兒(er)(er)園(yuan)(yuan)(yuan)必要(yao)(yao)(yao)(yao)建(jian)(jian)設(she)用(yong)地(di)及時(shi)(shi)納入國(guo)土空(kong)間規劃(hua)(hua),按(an)相關規定劃(hua)(hua)撥建(jian)(jian)設(she)用(yong)地(di)。住房城鄉建(jian)(jian)設(she)部(bu)(bu)(bu)門(men)要(yao)(yao)(yao)(yao)加(jia)強對(dui)城鎮小(xiao)(xiao)區配(pei)(pei)套(tao)(tao)幼兒(er)(er)園(yuan)(yuan)(yuan)的(de)(de)建(jian)(jian)筑設(she)計(ji)、施(shi)工建(jian)(jian)設(she)、驗(yan)收、移(yi)(yi)交的(de)(de)監管落(luo)(luo)實。機(ji)構(gou)(gou)編(bian)(bian)制(zhi)部(bu)(bu)(bu)門(men)按(an)程序(xu)做(zuo)好小(xiao)(xiao)區配(pei)(pei)套(tao)(tao)幼兒(er)(er)園(yuan)(yuan)(yuan)移(yi)(yi)交涉及的(de)(de)機(ji)構(gou)(gou)編(bian)(bian)制(zhi)工作,根(gen)據(ju)辦園(yuan)(yuan)(yuan)性質,分別由機(ji)構(gou)(gou)編(bian)(bian)制(zhi)部(bu)(bu)(bu)門(men)和民(min)政(zheng)部(bu)(bu)(bu)門(men)依法(fa)辦理(li)事業單位法(fa)人登(deng)記或(huo)民(min)辦非(fei)企業單位法(fa)人登(deng)記。在治(zhi)理(li)工作中,需要(yao)(yao)(yao)(yao)其他相關部(bu)(bu)(bu)門(men)支持配(pei)(pei)合的(de)(de),地(di)方各級人民(min)政(zheng)府要(yao)(yao)(yao)(yao)加(jia)強統(tong)籌(chou)協調。
3.加強(qiang)治(zhi)(zhi)理(li)(li)工(gong)(gong)(gong)(gong)作(zuo)保(bao)障(zhang)。地方各級人民政府要(yao)認真制(zhi)定(ding)(ding)治(zhi)(zhi)理(li)(li)工(gong)(gong)(gong)(gong)作(zuo)方案,明確治(zhi)(zhi)理(li)(li)步驟,細化工(gong)(gong)(gong)(gong)作(zuo)分工(gong)(gong)(gong)(gong),壓實部(bu)門責(ze)(ze)任,完善治(zhi)(zhi)理(li)(li)舉(ju)(ju)措,確保(bao)治(zhi)(zhi)理(li)(li)工(gong)(gong)(gong)(gong)作(zuo)如(ru)期完成(cheng)(cheng)。要(yao)加強(qiang)社會監督,及時向社會公(gong)布治(zhi)(zhi)理(li)(li)工(gong)(gong)(gong)(gong)作(zuo)方案、整(zheng)改(gai)措施及治(zhi)(zhi)理(li)(li)結(jie)果。暢通群眾(zhong)反映意見渠道(dao),設立并公(gong)布監督舉(ju)(ju)報電(dian)話和信(xin)箱。健全部(bu)門工(gong)(gong)(gong)(gong)作(zuo)聯動(dong)、形(xing)勢研判和應(ying)急反應(ying)機制(zhi),妥(tuo)善處理(li)(li)突發事(shi)件,堅決(jue)維護社會穩(wen)定(ding)(ding)。對(dui)在治(zhi)(zhi)理(li)(li)工(gong)(gong)(gong)(gong)作(zuo)中發現的(de)造(zao)成(cheng)(cheng)學前教育資(zi)源(yuan)嚴重流失(shi)等(deng)失(shi)職瀆職行(xing)為(wei)和違法(fa)違紀(ji)案件,要(yao)依(yi)法(fa)依(yi)規(gui)(gui)追(zhui)究(jiu)責(ze)(ze)任。要(yao)及時總(zong)結(jie)治(zhi)(zhi)理(li)(li)情況(kuang),制(zhi)定(ding)(ding)完善小區配套幼兒園建設管理(li)(li)辦法(fa),形(xing)成(cheng)(cheng)規(gui)(gui)范管理(li)(li)的(de)長效機制(zhi)。
各省(自治區、直轄市)治理(li)(li)工(gong)作方(fang)案、反映意見渠道以及摸底排查、整改等(deng)情況,要及時報送治理(li)(li)工(gong)作聯合(he)辦公室。
