各區(新區)教育行政(zheng)部門(men)(men)、人力(li)資源和(he)社會(hui)保障部門(men)(men)、財(cai)政(zheng)部門(men)(men),各職業院(yuan)校,各校外公共(gong)實訓基地: 為貫徹《教育(yu)(yu)部等(deng)五部門(men)關于印發〈職(zhi)業(ye)學校(xiao)學生實習(xi)(xi)管(guan)理(li)規定〉的(de)(de)通知(zhi)》(教職(zhi)成〔2016〕3號)、《中共(gong)深(shen)圳(zhen)市(shi)(shi)委 深(shen)圳(zhen)市(shi)(shi)人民政(zheng)府印發〈關于促(cu)進(jin)人才優(you)先發展(zhan)的(de)(de)若干措施(shi)〉的(de)(de)通知(zhi)》(深(shen)發〔2016〕9號)、《深(shen)圳(zhen)市(shi)(shi)人民政(zheng)府關于加快建設(she)現(xian)代職(zhi)業(ye)教育(yu)(yu)體系(xi)的(de)(de)意見》(深(shen)府〔2017〕49號)等(deng)文件精(jing)神,促(cu)進(jin)我(wo)市(shi)(shi)職(zhi)業(ye)教育(yu)(yu)校(xiao)企(qi)合作,創新技術技能(neng)人才培養(yang)模(mo)式,加強職(zhi)業(ye)院校(xiao)(含(han)技工院校(xiao),下同(tong))學生實習(xi)(xi)管(guan)理(li),完(wan)善實習(xi)(xi)補貼(tie)工作,現(xian)將有關事(shi)項通知(zhi)如下:
一、加強學生實習管理,健全考核評價制
職業(ye)院校應(ying)當建(jian)立健全學(xue)生(sheng)實(shi)(shi)習(xi)(xi)實(shi)(shi)訓(xun)相(xiang)關制度,確保學(xue)生(sheng)實(shi)(shi)習(xi)(xi)實(shi)(shi)訓(xun)取得(de)成效,并規范相(xiang)關補貼的申報和發放工(gong)作。具(ju)體要(yao)求(qiu)如下:
(一)規范實習管理基礎制度。職(zhi)業院校(xiao)校(xiao)外公(gong)共(gong)實(shi)(shi)(shi)(shi)訓基地、實(shi)(shi)(shi)(shi)習(xi)企(qi)業等應當根(gen)據(ju)工(gong)作(zuo)的實(shi)(shi)(shi)(shi)際情況及管理(li)要求(qiu),制(zhi)(zhi)定(ding)學生實(shi)(shi)(shi)(shi)習(xi)工(gong)作(zuo)具體管理(li)辦法和安(an)(an)全(quan)管理(li)規(gui)定(ding)、實(shi)(shi)(shi)(shi)習(xi)學生安(an)(an)全(quan)及突發事件應急預案等制(zhi)(zhi)度性文件,切實(shi)(shi)(shi)(shi)規(gui)范與完善學生實(shi)(shi)(shi)(shi)習(xi)有關(guan)管理(li)。建立學生實(shi)(shi)(shi)(shi)習(xi)強制(zhi)(zhi)保(bao)險制(zhi)(zhi)度,職(zhi)業院校(xiao)和實(shi)(shi)(shi)(shi)習(xi)單位應當根(gen)據(ju)國家有關(guan)規(gui)定(ding),為(wei)實(shi)(shi)(shi)(shi)習(xi)學生投保(bao)實(shi)(shi)(shi)(shi)習(xi)責任(ren)保(bao)險,責任(ren)保(bao)險范圍應覆蓋實(shi)(shi)(shi)(shi)習(xi)活動全(quan)過(guo)程。
(二)嚴格實習考勤紀律。確保相關(guan)申報(bao)數據的真實性,學校和企(qi)業(ye)要加強實習學生(sheng)的考(kao)(kao)勤管(guan)理,實習學生(sheng)、帶隊教師、企(qi)業(ye)管(guan)理人(ren)員(yuan)要對(dui)考(kao)(kao)勤情況的真實性負責。學校與企(qi)業(ye)應建立學生(sheng)實習考(kao)(kao)勤臺賬及實習檢查日志,并由實習學生(sheng)、帶隊教師、企(qi)業(ye)管(guan)理人(ren)員(yuan)共同簽名確認。
(三)認真篩選實習單位。職(zhi)業(ye)院(yuan)校(xiao)應(ying)(ying)(ying)當(dang)選(xuan)擇合(he)法經營、管(guan)理(li)規范(fan)、實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)設備完備、符合(he)安全生(sheng)(sheng)產法律(lv)法規要求的(de)(de)實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)單(dan)位(wei)(wei)(wei)安排學(xue)生(sheng)(sheng)實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)。一是(shi)(shi)評估(gu)(gu)實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)單(dan)位(wei)(wei)(wei)。在確定實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)單(dan)位(wei)(wei)(wei)前(qian),學(xue)校(xiao)應(ying)(ying)(ying)進行(xing)實(shi)(shi)(shi)(shi)(shi)地考察(cha)評估(gu)(gu)形成(cheng)書(shu)(shu)面報(bao)(bao)告,考察(cha)內容應(ying)(ying)(ying)包括:單(dan)位(wei)(wei)(wei)資質(zhi)(zhi)、誠信狀況(kuang)、管(guan)理(li)水平、實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)崗位(wei)(wei)(wei)性(xing)質(zhi)(zhi)和內容、工(gong)作時(shi)間、工(gong)作環境、生(sheng)(sheng)活環境以及健康保障、安全防護、可接收實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)人數、是(shi)(shi)否與專業(ye)人才(cai)培養吻(wen)合(he)、實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)學(xue)生(sheng)(sheng)占(zhan)在崗人數比例等方(fang)(fang)面。二(er)是(shi)(shi)制定實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)計(ji)劃。職(zhi)業(ye)院(yuan)校(xiao)與評估(gu)(gu)合(he)格的(de)(de)單(dan)位(wei)(wei)(wei)共同(tong)制訂(ding)(ding)實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)計(ji)劃,明(ming)確實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)目(mu)標(biao)、實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)任務、必要的(de)(de)實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)準備、考核標(biao)準等。三是(shi)(shi)簽訂(ding)(ding)三方(fang)(fang)協議。學(xue)生(sheng)(sheng)在頂(ding)(ding)崗實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)前(qian),學(xue)校(xiao)、實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)單(dan)位(wei)(wei)(wei)、學(xue)生(sheng)(sheng)三方(fang)(fang)應(ying)(ying)(ying)簽訂(ding)(ding)實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)協議,實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)協議應(ying)(ying)(ying)明(ming)確各方(fang)(fang)責任、權(quan)利義(yi)務及實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)報(bao)(bao)酬,未滿18歲的(de)(de)學(xue)生(sheng)(sheng)還應(ying)(ying)(ying)取得學(xue)生(sheng)(sheng)監護人的(de)(de)知情同(tong)意書(shu)(shu)。四是(shi)(shi)支付實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)報(bao)(bao)酬。接收學(xue)生(sheng)(sheng)頂(ding)(ding)崗實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)的(de)(de)實(shi)(shi)(shi)(shi)(shi)習(xi)(xi)單(dan)位(wei)(wei)(wei),應(ying)(ying)(ying)支付不低于本(ben)單(dan)位(wei)(wei)(wei)相同(tong)崗位(wei)(wei)(wei)試用期工(gong)資標(biao)準80%的(de)(de)報(bao)(bao)酬。
(四)加強監督管理。職(zhi)業(ye)學(xue)校(xiao)和實(shi)習(xi)企業(ye)不(bu)得向學(xue)生(sheng)(sheng)收取實(shi)習(xi)押(ya)(ya)金、頂崗實(shi)習(xi)報酬提(ti)成、管理(li)費(fei)或者其(qi)他(ta)形式(shi)的實(shi)習(xi)費(fei)用,不(bu)得扣押(ya)(ya)學(xue)生(sheng)(sheng)的居(ju)民身份證,不(bu)得要(yao)求學(xue)生(sheng)(sheng)提(ti)供擔保或者以其(qi)他(ta)名義(yi)收取學(xue)生(sheng)(sheng)財物(wu)。市教(jiao)育、市人力資(zi)源保障部門(men)(men)和申(shen)報學(xue)校(xiao)要(yao)做(zuo)好補(bu)貼對(dui)象、補(bu)貼時間的核對(dui)與認定工作。對(dui)于虛報、冒(mao)領、擠占、挪用、滯(zhi)留國家相關(guan)(guan)補(bu)助(zhu)資(zi)金的部門(men)(men)和學(xue)校(xiao),要(yao)予(yu)以嚴肅處理(li),涉(she)嫌(xian)犯罪的,依法移(yi)送司法機關(guan)(guan)處理(li)。
(五)確保學生實習安全。不(bu)(bu)得(de)安(an)(an)(an)(an)排未(wei)成年(nian)學(xue)(xue)(xue)生從(cong)(cong)事(shi)《未(wei)成年(nian)工(gong)(gong)特殊保護規(gui)(gui)定(ding)》中(zhong)禁(jin)止(zhi)從(cong)(cong)事(shi)的勞(lao)動(dong),不(bu)(bu)得(de)安(an)(an)(an)(an)排女(nv)學(xue)(xue)(xue)生從(cong)(cong)事(shi)《女(nv)職工(gong)(gong)勞(lao)動(dong)保護特別規(gui)(gui)定(ding)》中(zhong)禁(jin)止(zhi)從(cong)(cong)事(shi)的勞(lao)動(dong),不(bu)(bu)得(de)安(an)(an)(an)(an)排學(xue)(xue)(xue)生到(dao)酒吧、夜總會(hui)、歌廳、洗浴(yu)中(zhong)心等營業(ye)(ye)(ye)性(xing)娛樂場所實(shi)(shi)(shi)(shi)習(xi)(xi)(xi)(xi),不(bu)(bu)得(de)通(tong)過中(zhong)介(jie)機構或有償代(dai)理(li)組織、安(an)(an)(an)(an)排和(he)(he)管理(li)學(xue)(xue)(xue)生實(shi)(shi)(shi)(shi)習(xi)(xi)(xi)(xi)工(gong)(gong)作(zuo)。除相關專業(ye)(ye)(ye)和(he)(he)實(shi)(shi)(shi)(shi)習(xi)(xi)(xi)(xi)崗位有特殊要(yao)求,并報上級主管部(bu)門備案(an)的實(shi)(shi)(shi)(shi)習(xi)(xi)(xi)(xi)安(an)(an)(an)(an)排外,接(jie)收(shou)職業(ye)(ye)(ye)院校學(xue)(xue)(xue)生實(shi)(shi)(shi)(shi)習(xi)(xi)(xi)(xi)的企業(ye)(ye)(ye)應遵守國家關于工(gong)(gong)作(zuo)時間和(he)(he)休息(xi)休假的規(gui)(gui)定(ding),不(bu)(bu)得(de)安(an)(an)(an)(an)排學(xue)(xue)(xue)生從(cong)(cong)事(shi)高空、放射性(xing)、有毒(du)、易燃易爆等較高安(an)(an)(an)(an)全風險(xian)的實(shi)(shi)(shi)(shi)習(xi)(xi)(xi)(xi),不(bu)(bu)得(de)安(an)(an)(an)(an)排學(xue)(xue)(xue)生在法定(ding)節(jie)假日實(shi)(shi)(shi)(shi)習(xi)(xi)(xi)(xi),不(bu)(bu)得(de)安(an)(an)(an)(an)排學(xue)(xue)(xue)生加班和(he)(he)夜班。對安(an)(an)(an)(an)排、介(jie)紹(shao)或者接(jie)收(shou)未(wei)滿16周歲學(xue)(xue)(xue)生實(shi)(shi)(shi)(shi)習(xi)(xi)(xi)(xi)的學(xue)(xue)(xue)校或企業(ye)(ye)(ye),人力資源部(bu)門應當依(yi)據(ju)《禁(jin)止(zhi)使(shi)用童(tong)工(gong)(gong)規(gui)(gui)定(ding)》進行查處;涉嫌犯(fan)罪的,依(yi)法移送(song)司(si)法機關處理(li)。
(六)健全考核評價制度。切實(shi)(shi)(shi)做好(hao)學(xue)生實(shi)(shi)(shi)習(xi)(xi)(xi)情況立卷歸檔(dang)工(gong)(gong)作(zuo)(zuo),建立健全實(shi)(shi)(shi)習(xi)(xi)(xi)考(kao)(kao)核(he)評(ping)價制(zhi)度。學(xue)校應(ying)當依據實(shi)(shi)(shi)習(xi)(xi)(xi)計(ji)劃,制(zhi)定具體(ti)考(kao)(kao)核(he)方式和標準,實(shi)(shi)(shi)習(xi)(xi)(xi)完成后要及時(shi)做好(hao)學(xue)生實(shi)(shi)(shi)習(xi)(xi)(xi)情況立卷歸檔(dang)工(gong)(gong)作(zuo)(zuo),對實(shi)(shi)(shi)習(xi)(xi)(xi)單位評(ping)估報(bao)告、實(shi)(shi)(shi)習(xi)(xi)(xi)協議、實(shi)(shi)(shi)習(xi)(xi)(xi)計(ji)劃、實(shi)(shi)(shi)習(xi)(xi)(xi)責任保險單據、學(xue)生實(shi)(shi)(shi)習(xi)(xi)(xi)報(bao)告、學(xue)生實(shi)(shi)(shi)習(xi)(xi)(xi)考(kao)(kao)核(he)結(jie)果(guo)、實(shi)(shi)(shi)習(xi)(xi)(xi)考(kao)(kao)勤日(ri)志、實(shi)(shi)(shi)習(xi)(xi)(xi)檢查記錄、實(shi)(shi)(shi)習(xi)(xi)(xi)總結(jie)等(deng)資料及時(shi)歸檔(dang)。
二、完善實習補貼工作(zuo),規范補貼申領流程
(一)調整(zheng)頂崗(gang)實習補貼范圍(wei)。
自2018年秋(qiu)季學期起,對包括民辦職(zhi)(zhi)業(ye)院校(xiao)在(zai)內的(de)所(suo)有職(zhi)(zhi)業(ye)院校(xiao)全日制學生(sheng)頂崗(gang)實習給予補(bu)貼。
(二)實習補貼對象、標準及期限。
1.補貼對(dui)象。實(shi)(shi)(shi)習補貼對(dui)象包括:一是(shi)我市(shi)(shi)(shi)職(zhi)業院校(xiao)參加(jia)實(shi)(shi)(shi)習實(shi)(shi)(shi)訓(xun)的全(quan)日制在校(xiao)學(xue)生;二是(shi)經(jing)市(shi)(shi)(shi)教(jiao)育局、市(shi)(shi)(shi)人力資(zi)源和(he)社會保障(zhang)局認定并接(jie)收(shou)職(zhi)業院校(xiao)全(quan)日制學(xue)生實(shi)(shi)(shi)習實(shi)(shi)(shi)訓(xun)的職(zhi)業教(jiao)育校(xiao)外(wai)公共(gong)實(shi)(shi)(shi)訓(xun)基地所在企業。
2.補貼標準。參加實(shi)習(xi)實(shi)訓學生每人(ren)每月可享受650元生活補(bu)貼和教育部規定的學生實(shi)習(xi)責任保(bao)險。校外公共實(shi)訓基(ji)地所在企業,按接(jie)收(shou)實(shi)習(xi)實(shi)訓學生人(ren)數(shu)給予(yu)每人(ren)每月300元的補(bu)貼。
3.補貼時間。教育部(bu)門主(zhu)管的(de)職業(ye)學校學生實習時間(jian)為6個(ge)月,人力資源(yuan)保(bao)障部(bu)門主(zhu)管的(de)技(ji)工(gong)院校學生實習時間(jian)為12個(ge)月。學生實習補貼(tie)金額根(gen)據學生實際實習工(gong)作時間(jian)確定。
(三)頂崗實習補貼申領流程。
頂崗實習補(bu)貼由參加實習實訓學(xue)生所在(zai)學(xue)校統一申領(ling)。
1.填報資料。學校在(zai)學生頂崗(gang)實(shi)(shi)(shi)習(xi)(xi)(xi)結束后(hou)應(ying)認真做(zuo)好學生實(shi)(shi)(shi)習(xi)(xi)(xi)補(bu)貼(tie)(tie)和(he)校外公共實(shi)(shi)(shi)訓基地接(jie)收學生實(shi)(shi)(shi)習(xi)(xi)(xi)補(bu)貼(tie)(tie)報表、匯總表填報工作,報表信(xin)息包(bao)括學生姓名、身(shen)份證號碼、所(suo)在(zai)班(ban)級、實(shi)(shi)(shi)習(xi)(xi)(xi)崗(gang)位(wei)、實(shi)(shi)(shi)習(xi)(xi)(xi)企業(ye)、實(shi)(shi)(shi)習(xi)(xi)(xi)時間、補(bu)貼(tie)(tie)金額、實(shi)(shi)(shi)習(xi)(xi)(xi)補(bu)貼(tie)(tie)發放賬號及學生本人簽名等內容,確(que)保上(shang)報信(xin)息完整、真實(shi)(shi)(shi)準確(que)。
2.組(zu)織核查。學(xue)校(xiao)應當對(dui)所申報學(xue)生(sheng)實習補(bu)貼(tie)的申報材料進行核查。學校可以聘請有資質的會計師事務所開展(zhan)上述(shu)工作(zuo)。學校或者會計師事務所應(ying)認真核(he)查實(shi)(shi)(shi)(shi)習(xi)企業評估報告、實(shi)(shi)(shi)(shi)習(xi)協議(包(bao)括知情(qing)同意(yi)書)、實(shi)(shi)(shi)(shi)習(xi)計劃、實(shi)(shi)(shi)(shi)習(xi)責任(ren)保險單據、學(xue)(xue)生(sheng)實(shi)(shi)(shi)(shi)習(xi)報告、學(xue)(xue)生(sheng)實(shi)(shi)(shi)(shi)習(xi)考(kao)核(he)結果(guo)、實(shi)(shi)(shi)(shi)習(xi)總結等資料,通(tong)過檢查學(xue)(xue)生(sheng)學(xue)(xue)籍、頂(ding)崗(gang)實(shi)(shi)(shi)(shi)習(xi)考(kao)勤日志、頂(ding)崗(gang)實(shi)(shi)(shi)(shi)習(xi)檢查記錄對(dui)頂(ding)崗(gang)實(shi)(shi)(shi)(shi)習(xi)人數(shu)、時間及(ji)補貼金額進(jin)行核(he)查,并形成核(he)查報告。
3.公示名單。學校應將(jiang)擬獲(huo)得補貼的學生、實習所在(zai)單(dan)位及補貼金額在(zai)校內公(gong)示7日。
4.報送材料和審核(he)。公(gong)示無異議后,學校將(jiang)報(bao)(bao)(bao)(bao)表(biao)副本(ben)、匯總表(biao)和公(gong)示文(wen)件(jian)(附電子文(wen)檔)及核查報(bao)(bao)(bao)(bao)告報(bao)(bao)(bao)(bao)送市(shi)教育(yu)部門(men)或(huo)者市(shi)人力資源保障(zhang)部門(men)審核。首次申請頂崗實(shi)習補貼的學校應(ying)當將(jiang)實(shi)習管理(li)相關制度文(wen)件(jian)報(bao)(bao)(bao)(bao)送市(shi)教育(yu)部門(men)或(huo)者市(shi)人力資源保障(zhang)部門(men)。制度文(wen)件(jian)包(bao)括:實(shi)習工(gong)作(zuo)具(ju)體(ti)管理(li)辦法(fa)和安全管理(li)規定、實(shi)習學生(sheng)安全及突發(fa)事件(jian)應(ying)急預(yu)案、學生(sheng)考勤管理(li)規定等制度性文(wen)件(jian)。上述制度文(wen)件(jian)發(fa)生(sheng)變化、調整的,也(ye)應(ying)及時報(bao)(bao)(bao)(bao)送。
市教育部門(men)或者市人力資源保障部門(men)自收(shou)到材料之日起,15個工作日內予以審核,并(bing)作出是否同(tong)意(yi)發(fa)放補貼的決(jue)定(ding)。作出不同(tong)意(yi)發(fa)放補貼決(jue)定(ding)的,將相(xiang)關(guan)理(li)由(you)一并(bing)告(gao)知申報(bao)學(xue)校。
5.申報補貼時間。學(xue)校實(shi)(shi)習(xi)補(bu)貼(tie)每年按學(xue)期申報(bao)兩次,即于(yu)每年4月1-15日(ri)(ri)申報(bao)秋季(ji)學(xue)期頂崗實(shi)(shi)習(xi)補(bu)貼(tie)、每年10月1-15日(ri)(ri)申報(bao)春季(ji)學(xue)期頂崗實(shi)(shi)習(xi)補(bu)貼(tie)。
6.發放補貼。公辦(ban)學校(xiao)實(shi)(shi)習(xi)補貼經費按(an)現行(xing)預算(suan)模(mo)式管(guan)理。民辦(ban)學校(xiao)實(shi)(shi)習(xi)補貼經費納入主管(guan)部(bu)門年度(du)部(bu)門預算(suan)安排,由市教育部(bu)門或(huo)者市人力(li)資(zi)源保(bao)障部(bu)門發(fa)(fa)(fa)放給各(ge)相關學校(xiao),學校(xiao)應(ying)在收到(dao)補貼經費后(hou)30日內(nei)通過轉賬的方式及(ji)時(shi)發(fa)(fa)(fa)放到(dao)實(shi)(shi)習(xi)學生和(he)企業(ye)提供的銀行(xing)賬號。補貼發(fa)(fa)(fa)放結束后(hou),學校(xiao)應(ying)及(ji)時(shi)將(jiang)發(fa)(fa)(fa)放情況報主管(guan)部(bu)門匯總。
三(san)、保障措施(shi)
(一)加強組織領導,完善工作機制。擴(kuo)大(da)頂崗實(shi)習補貼范圍(wei),調整實(shi)習時間,涉及面廣(guang),政策性強,要按(an)照教育部(bu)及市委、市政府的要求(qiu)做好(hao)各項工作(zuo)。各區(qu)(含新(xin)區(qu),下同)、各職業院校要加強組織(zhi)領導,抓緊(jin)制訂相關(guan)實(shi)施(shi)方(fang)案(an),明(ming)確責任分工,建立健全工作(zuo)制度,切實(shi)抓好(hao)工作(zuo)落實(shi),確保實(shi)習補貼工作(zuo)做到公(gong)開、公(gong)平(ping)、公(gong)正。
(二)加強監督檢查,明確管理責任。市、區教育部(bu)門(men)和人力資源保障部(bu)門(men)要(yao)加強監督(du)檢(jian)查(cha),加強對職業院校(xiao)、校(xiao)外公(gong)共(gong)實(shi)訓(xun)基地情況進行(xing)監督(du)檢(jian)查(cha),并公(gong)布檢(jian)查(cha)結果;要(yao)嚴格規(gui)范學生學籍管(guan)理工作,進一步完(wan)善學生信(xin)息管(guan)理系統,杜絕冒名代領、弄虛作假(jia)、徇(xun)私舞弊等現象發(fa)(fa)生。實(shi)習補貼經(jing)費(fei)實(shi)行(xing)專款專用,對擠占、挪用和違(wei)規(gui)發(fa)(fa)放(fang)實(shi)習貼補專項(xiang)經(jing)費(fei)的(de)學校(xiao)將追究相關責任(ren)人的(de)責任(ren);涉嫌犯(fan)罪的(de),依法移送司法機關處理。
